Regular City Council Meeting Minutes
City of
Porter
Tuesday,
September 8, 2009,
6:30 p.m.
Mayor
Donald Verschelde called the regular city council meeting to order.
Council
members present were Eric Dybsetter, Kim Jelen, Darlene Moeller, Donald
Verschelde, Judy Verschelde, and Pat Vlaminck.
Mayor
Donald Verschelde called for the reading of the minutes of the August 3, 2009 City Council meeting.
Minutes were approved as read in a
motion by Pat Vlaminck, seconded by Kim Jelen. All were in favor with none
opposed, and the motion was carried.
Porter’s
on-sale liquor license fee was discussed.
Based on the situations in surrounding similar communities, the
consensus was to leave the license fee at $1500 per year, or $375 per
quarter. It was also discussed
that adding pull tabs to the Cut Loose Lounge could help add revenue for
both the bar and the city.
A city
clean up day was discussed. The
consensus of the council was to have a clean up day again this fall.
Don Verschelde and Judy Verschelde will work with
Olson Sanitation to schedule it.
Resolution 04-2009
WHEREAS,
State Court Administration is automating the distribution of fines and fees
collection on law enforcement citations, and
Whereas,
Minn. Statute
484.90, et. Seq., was amended by the Minnesota Legislature in 2009 to
facilitate this fine and fee distribution method, and
Whereas,
certain jurisdictions who designate a prosecutor for state law violations by
contract or by resolution will receive fine revenue from many of the
citations issued in their jurisdiction, and
Whereas,
the Porter City Attorney had, has, and will continue to exercise
prosecutorial jurisdiction in the City of Porter, Yellow Medicine County,
and
Whereas,
the City of Porter
desires to receive the fine revenue available by this distribution method,
NOW
THEREFORE, pursuant to Minn. Statute 484.87, subd. 3, and 484.90 as amended,
the City of Porter designates the law firm of Qualley,
Boulton & Vinberg, as its prosecuting authority for petty misdemeanor,
misdemeanor and designated gross misdemeanor state law violations occurring
within its jurisdiction.
A motion
was made by Kim Jelen, seconded by Pat Vlaminck, to approve Resolution
04-2009. All were in favor with
none opposed, and the motion was carried.
Eric
Dybsetter will ask Jerry Boulton about the city not sharing in the revenue
from past fines. Kim Jelen
believes that Porter should have been receiving about 2/3.
A
donation to Western Minnesota Prairie Waters was discussed, and it was
decided to not make a donation in 2010.
Pat
Vlaminck discussed the proposed 800 MHz county wide radio system.
The system would be used by all law enforcement, fire departments,
and first responders / EMTs. All
physical infrastructure will not be installed for several years, but grants
will cover much or all of the costs to the Porter Fire Department and Porter
First Responders.
Midwest
Pump has completed the annual inspection of fire trucks.
All trucks passed inspection and are fully certified.
The
council discussed how to deal with the black dirt remaining from excavation
at the fire hall expansion.
Several people have inquired about taking the dirt.
The council will check with Larry Stoks as to the dirt’s value.
Pat
Vlaminck gave the council an update on the fire hall expansion project.
Construction has started, with the concrete floor being poured, and
walls and trusses being erected.
It was
discussed that junk ordinance letters need to be sent to Alan Merritt, Greg
Kloos and Jesse Denelsbeck.
Darlene
Moeller made a motion to pay the bills as read by Judy Verschelde.
Kim Jelen seconded the motion.
All were in favor with none opposed, and the motion was carried.
A motion
was made by Kim Jelen, seconded by Darlene Moeller, to adjourn the meeting.
All were in favor with none opposed, and the motion was carried.
